This policy applies to the website https://byleonemarketing.com. It complies with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD). A section is dedicated to people located in Quebec.

In brief

We only collect the data you send us through the contact form or when you book an appointment.
It is used solely to reply to you and to discuss a possible engagement.
No resale, no transfer, no profiling, no newsletter.
No audience measurement or advertising cookies on the website. Only the booking calendar (Calendly) may set its own cookies.

Data processed

Contact form:

your name;
your company (optional);
your email address;
the subject of your request (chosen from a list);
your message.

Before sending, a mandatory checkbox confirms that you have read this information.

Record of submission: we keep the date of submission, the version of the information text displayed and a pseudonymised fingerprint (hash) of your IP address. Your IP address itself is not stored in clear.

Spam protection: the form uses an invisible honeypot field, a minimum completion time and a limit on the number of submissions per IP address (based on its pseudonymised fingerprint). No cookies are used for this.

We do not make any automated decisions and do not carry out any profiling.

Retention periods

Prospects (requests not followed up): 3 years after our last contact, then deleted.
Clients: for the periods required by accounting and tax regulations.
Record of submission: for the same period as the request to which it relates.

Recipients of the data

Infomaniak Network SA (Geneva, Switzerland) hosts the website, the data and the email service, as a processor.
Calendly LLC (Atlanta, United States) provides the booking calendar, as a processor: it processes the information entered when booking (name, email address, answers to questions, chosen time slot).
The people who assist Léone Marketing on marketing engagements, in particular the “Namako” team (Madagascar), do not have access to the data sent through the website's contact form.
We do not transfer or sell your data to third parties, unless required by law.

Transfers outside the European Union

The website's data is hosted in Switzerland. Switzerland benefits from an adequacy decision of the European Commission, which recognises that it offers a level of protection equivalent to that of the European Union.

Appointment booking goes through Calendly, which is based in the United States. This transfer relies on the EU–US Data Privacy Framework, to which Calendly states that it adheres.

Online appointment booking

Appointments are booked with Calendly. On the contact page, the calendar is displayed directly; on the other pages, it only loads when you click a booking button.

The information you enter (name, email address, answers to questions, chosen time slot) is used to organise and prepare the appointment. It is deleted from Calendly after the same periods as contact requests. Calendly processes it on our behalf: please also read its privacy policy.

The website contains a link to LinkedIn. If you click it, you leave the website and LinkedIn's privacy policy applies.

No newsletter is sent at present. If this changes, your consent will be requested beforehand, separately from the contact form.

Your rights

You can request at any time:

access to your data;
its rectification or erasure;
the restriction of its processing;
its portability;
and object to its processing.

Write to hola@byleonemarketing.com, stating which right you wish to exercise. We may ask you to prove your identity if there is any doubt.

Complaints

If you believe your data has not been processed correctly, you can lodge a complaint with the Spanish data protection authority, the Agencia Española de Protección de Datos (AEPD): www.aepd.es.

If you live in France, you can also contact the Commission nationale de l'informatique et des libertés (CNIL): www.cnil.fr.

People located in Quebec

For people located in Quebec, Léone Marketing also applies the Act respecting the protection of personal information in the private sector, as amended by Law 25.
